The Civil Rights Committee of the Kuala Lumpur and Selangor Chinese Assembly Hall (CRC-KLSCAH) and Suara Rakyat Malaysia (SUARAM) will be holding a forum discussion on the role of constitutional monarch in a democratizing Malaysia.

Constitutional monarchs are seen by some quarters as the guardian of democracy against the wrongdoing of elected politicians. Free from electoral pressure, the sovereign may act in the real interest of the nation better than politicians. From this perspective, many see their Royal Highnesses the Sultan and Crown Prince of Perak as the model national leaders for their stances on judiciary independence and an inclusive nationhood.

The March 8 elections ushered in new political reality which changes the operational setting for "interventionist monarchs". Alongside the Opposition parties, the palaces have been empowered. This does not only happen in Perak and Selangor where new parties have come into power with slim majority in the legislature, but also in Perlis and Terengganu where the incumbent BN secured two-thirds of the legislature. In the standoff in Terengganu, the palace and the legislative majority have had completely opposite preferences.

Is such royal intervention in government formation constitutional according to the letters of the law? Beyond legality, is it in line with the norm of constitutional monarchies where the monarchs are only the figurehead? Can the palace, an unelected institution, dictate who should head the government and who sit in the cabinet? In the context of democratization, is the ascendance of royal power at the expense of the declining hegemonic party desirable?

全国大选过后，玻璃市、霹雳、雪兰莪及登嘉楼各州相继出现皇权抬头，介入州务大臣与行政议员委任等事务，而以登嘉楼州务大臣人选问题引发最大争议。为此，隆雪华堂民权委员会与大马人民之声联办"皇室干政？——谈民主转型及其挑战"讲座，希望以此剖析新政局的发展，反思我国的宪政架构，丰富公众对民主政治的认识。

法律界人士认为，大选后政治版图发生巨变，而主流政党实力消褪之余，发生皇权抬头，对民主转型之影响值得省思。有论者以为这是破坏宪政精神的先声，应该制止皇权扩张；而有论者则以为这些州统治者并未逾越州宪法的限制，并且理应维持族群社会稳定以及摒弃涉嫌贪腐之人选。

主办单位希望讨论以下三个问题：
一、宪政结构：分析联邦宪法以及州宪法有关君权的规定，并从历史的角度反思宪政架构的草创及其意涵，这样的架构是否可欲，值得延续至未来。而80年代起至今数次的宪政危机又意味什么？
二、政局形势发展：不同的政党对此连串事件反应不一，其影响与意涵是什么？
三、民主转型的挑战：反思民主进程，除了政党政治、民间议政，究竟皇权抬头对民主转型的意义是什么，希望就此探索民主国家的转型过程及其挑战。

Truth and justice are no longer Malaysian way

THE Government of Australia will probably change hands this weekend. There will be no arrests, no tear gas and no water cannons. The Government of John Howard will leave office, the Opposition will form a government and everyone will accept the verdict.

For this, every Australian can feel justifiably proud. This playing by the rules is what has made Australia rich and a good place in which to invest. It is a country to which people want to migrate; not leave.

Now consider Malaysia. The weekend before last, up to 40,000 Malaysians took to the streets in Kuala Lumpur to protest peacefully against the judiciary's lack of independence, electoral fraud, corruption and a controlled media.

In response, they were threatened by the Prime Minister, called monkeys by his powerful son-in-law, and blasted with water cannons and tear gas. And yet the vast majority of Malaysians do not want a change of government. All they want is for their government to govern better.

Both Malaysia and Australia have a rule of law that's based on the English system. Both started out as colonies of Britain. So why is Malaysia getting it so wrong now?

Malaysia's Government hates feedback. Dissent is regarded as dangerous, rather than a product of diversity. And like the wicked witch so ugly that she can't stand mirrors, the Government of Prime Minister Abdullah Badawi controls the media so that it doesn't have to see its own reflection.

Demonstrations are typically banned. But what every Malaysian should know is that in Britain, Australia and other modern countries, when people wish to demonstrate, the police typically clear the way and make sure no one gets hurt. The streets belong to the people. And the police, like the politicians, are their servants. It is not the other way around.

But increasingly in Malaysia, Malaysians are being denied a voice — especially young people.

Section 15 of Malaysia's Universities and University Colleges Act states that no student shall be a member of or in any manner associate with any society, political party, trade union or any other organisation, body or group of people whatsoever, be it in or outside Malaysia, unless it is approved in advance and in writing by the vice-chancellor.

Nor can any student express or do anything that may be construed as expressing support, sympathy or opposition to any political party or union. Breaking this law can lead to a fine, a jail term or both.

The judiciary as a source of independent viewpoints has been squashed. The previous prime minister, Mahathir Mohamad, did many good things for Malaysia, but his firing of the Lord President (chief justice) and two other Supreme Court judges in 1988 was an unmitigated disaster. Since then, what passes for a judiciary in Malaysia has been an utter disgrace and the Government knows it.

Several years ago, Daim Zainuddin, the country's then powerful finance minister, told me that judges in Malaysia were idiots. Of course we want them to be biased, he told me, but not that biased.

Rarely do government ministers need to telephone a judge and demand this or that verdict because the judges are so in tune with the Government's desires that they automatically do the Government's beckoning.

Just how appalling Malaysia's judiciary has become was made clear in recent weeks with the circulation of a video clip showing a senior lawyer assuring someone by telephone that he will lobby the Government to have him made Lord President of the Supreme Court because he had been loyal to the Government. That someone is believed to have been Ahmad Fairuz Abdul Halim, who did in fact become Lord President.

A protest march organised by the Malaysian Bar Council was staged in response to this, and corruption among the judiciary in general. But the mainstream Malaysian media barely covered the march even though up to 2000 Bar Council members were taking part. Reportedly, the Prime Minister's office instructed editors to play down the event.

Instead of a free media, independent judges and open public debate, Malaysians are given stunts — the world's tallest building and most recently, a Malaysian cosmonaut. Essentially, they are given the play things of modernity but not modernity itself.

Many senior Malays are absolutely despairing at the direction of their country today. But with the media tightly controlled they have no way of getting their views out to their fellow countrymen. This means that most Malaysians falsely assume that the Malay elite is unified when it comes to the country's direction.

Tengku Razaleigh Hamzah, a former finance minister and today still a member of the Government, told me several weeks ago in Kuala Lumpur that he could see no reason why today Malaysia could not have a completely free media, a completely independent judiciary and that corrupt ministers and other officials should be publicly exposed and humiliated.

According to Tengku Razaleigh, all of the institutions designed to make Malaysia's Government accountable and honest have been dismantled or neutered.

It didn't need to be like this. Malaysia is not North Korea or Indonesia. It is something quite different. Its legal system is based on British codes. Coupled with traditional Malay culture, which is one of the world's most hospitable, decent and gentle cultures, Malaysia has the cultural and historical underpinnings to become one of Asia's most civilised, rules-based, successful societies.
Instead, Malaysia's Government is incrementally wasting Malaysia's inheritance.

不学无术的纳吉又再自以为是的以“一人之下，万人之上”的副首相身份发表干涉人民宪赋权利的言论。

《东方日报》报导，纳吉在周六呼吁身在缅甸的大马人民对缅甸军政府血腥镇压当地僧侣和平民的事件置身事外，不要插手缅甸的内政，包括不要参与当地民众发动的争取民主进程示威活动。

在我国，"官大，报纸版位特别大"是真的；但是，若有官大人硬要来自诩"官大学问大"，那就免了！

若纳吉真的坚持马来西亚全国上下，无论身为官民抑或身在国内或国外，一律奉行"不干预他国内政"的原则，那么这些年来我国官民发动群众游行声讨美国攻打伊拉克、谴责以色列血腥对待巴勒斯坦平民的抗议行动，纳吉也应该以同样的标准加以训斥和制止。但是，纳吉的立场和发言标准有一致吗？没有！他又再次于阿都拉出国的时候，发表压制异议的言论来凸显本身之威权，尝试展现自忖身为准首相接班人之果断作风的风范，可能还想一饱当一国之首来发号施令的虚荣。

然而，纳吉这番突兀的言论徒然自曝其短：

第一）集会、结社和言论自由是所有人的天赋人权，轮不到纳吉在人们合法行使权利的时刻来强加阻止。

第二）纳吉这番急急阻止马来西亚公民敦促缅甸政府从善如流、顺应民主趋势、放弃以武力对待异议的言论，越发凸显纳吉缺乏人道关怀、民主素养和正义感的缺陷，空有大官的心态，却没有大将之风范。

第三）纳吉在我国高等教育普及、民智渐开、各形各色传播媒介和公民交流平台随手可及的今日，如此不慎言，依然以从前主流媒体几乎垄断人民所有视听管道，官大人得以向民众单方面说教的旧式手法来回应议题，不只显示出纳吉与现代官民平等互动和对话之政治发展趋势的严重脱节，甚至予人觉得他有刻意摆出官威来凸显为官者自上而下优越感之嫌，难免让人民对他日后升正首相后，能否能体恤民情、贴近民生、与民同在抱持极大的怀疑。

当缅甸的僧侣以血肉之躯、缅甸的人民以身体发肤，勇敢地抵挡军人政权硬生生截断缅甸民主进程的枪杆弹雨时；缅甸临近国家首长级领袖呼吁自家人民漠视残杀生灵和践踏民主之暴行的言论，无不深刻的衬托与比较出人性的光辉与晦暗；人伦道德勇气的璀璨与堕落！

【《独立新闻在线》社论】资深法律工作者大抵都会认同，我国司法机关的独立性曾经备受赞许；不过，1988年以后，一切都不能同日而语了。1988年以降，几乎每隔几年就会爆出举国震惊的司法丑闻，所谓的“司法独立”及“司法机关的尊严”仿佛荡然无存；在有良知及见多识广的马来西亚人眼中，原应制衡行政机关的司法机关，其腐败程度并不亚于早已备受诟病的行政机关，甚至沦为行政机关的政治工具。

前首相马哈迪带给马来西亚的其中一个最大创伤，就是在1988年以行为不检的罪名将最高法院院长沙烈阿巴斯及另两名最高法院法官旺苏莱曼及佘锦成革职，创下最糟糕的先例。人们普遍认为，曾率领其他法官上书国家元首投诉马哈迪干预司法独立的沙烈阿巴斯，只不过是巫统党争的牺牲品，而试图维护法治的旺苏莱曼及佘锦成则遭受池鱼之殃。【点击：巫统党争殃及司法独立沙烈密函引爆司法危机】

1988年那场司法危机的错误示范，除了开除最高法院法官之外，就是营造“论功行赏”的腐败文化。当时马哈迪政府任命排名比沙烈阿巴斯低的马来亚大法官哈密奥玛（Hamid Omar）领导审判沙烈阿巴斯的仲裁庭及出任代院长；按照佘锦成的说法，这无异于“上校审判上将”。沙烈阿巴斯停职期间，哈密奥玛指示无限期展延“巫统11人”讼案；沙烈阿巴斯被革职后，哈密奥玛撤销“巫统11人”讼案，并顺利接任最高法院院长。【点击：沙烈停职前指示九司会审代院长无限期展延巫统案】

司法匿名信真或假？

1996年12月，司法界流传一封由高等法院法官撰写的33页匿名信，控诉12位法官（包括联邦法院大法官尤索夫晋）滥权腐败，“罪名”合计112项；总检察署将这些指责归类为滥权（21项）、贪污（39项）及行为不检与道德沦丧（52项）。

这封震撼司法界的匿名信，乃由当时的马来亚高等法院法官赛阿末依迪（Syed Ahmad Idid）所撰。当时的总检察长莫达阿都拉（Mokhtar Abdullah）不点名说已确认法官的身份，并宣称匿名信内容并不确实，但是政府没有向赛阿末依迪追究法律责任，只是让他辞职了事。

因此，令人置疑的是，倘若肩负维护司法公正的资深法官以匿名信对司法机关作如此严重的“不确实”控诉，为何不必承担法律责任？相对于马哈迪政府加诸于沙烈阿巴斯的罪名，赛阿末依迪所犯错误应该更严重。倘若赛阿末依迪的控诉不确实，为何声名遭沾污的12位法官，竟无一人起诉赛阿末依迪诽谤？

赛阿末依迪今年五月在马来亚大学演讲时，并没有否定当年的控诉，只是说道如果他还是法官，他也许会用另一种方式来做这些事，因为他相信有些原则必须秉持。【点击：广发司法界匿名信者另有其人前高庭法官：我只寄给七个人】

争议性官司和判决频传

司法机关的丑闻当然不限于此。企业大亨陈志远（Vincent Tan）的“御用律师”维卡纳伽林甘（V.K. Lingam）在1990年代帮他“打赢”一系列巨额诽谤诉讼（mega suits），但1998年互联网流传陈志远及林甘分别与当时的联邦法院首席大法官尤索夫晋（Eusoff Chin）及总检察长莫达阿都拉在纽西兰和意大利度假的合照。但是这两名司法高官却振振有词的以一般社交的说词辩解，而就要退休的尤索夫晋竟还获得延长六个月任期。

法院也闹出数宗极具争议性的官司判例，例如阿依摩立案（Ayer Molek）、美特拉美案（Metramac）及安华案等尤其备受瞩目。安华在1998年遭马哈迪革职后，复遭控以鸡奸罪及渎职罪；审讯期间暴露许多即使没有法学专业知识的民众都能看出的疑点，例如法院接纳控方证人反复不定的证词、被告的辩护律师挠双胞等，担任判处安华渎职罪成。

这些不胜枚举的司法丑闻和争议性判决，无不令人们对司法独立的信心不断消减；安华前天揭露维卡纳伽林甘在2002年的电话对谈中宣称可让陈志远游说马哈迪任命阿末法鲁斯（现任联邦法院首席大法官）出任上诉庭主席的丑闻，令人们更有理由怀疑，过去多年来的争议性官司的判决，乃政商要人幕后操纵的结果。

令人有偏见的印象就够了

安华前天揭露上述司法丑闻后，民间党团纷纷放话，或促请首席大法官请辞，或促请政府将首席大法官停职查办并成立仲裁庭彻查。这宗司法丑闻事关重大，联邦法院首席大法官乃司法机关首长，实有责任在第一时间向社会说明情况；但是时至今日，他及维卡纳伽林甘仍未出面否认此事。

上诉庭退休法官陈炘铠（N.H. Chan）最近出版新著《审判法官》（Judging the Judges），他在说中除了重申彰显公正（impartiality）是最重要的原则，因为正义必须被看到已得到伸张，还写了一段话：“实在没有必要说明法官方面的确存在偏见，才能责怪他有过失。如果他给其他人留下有偏见或不公平的印象，就已足够了。这关系到诉讼当事人或普通百姓怎么看他，也关乎法官本身如何让诉讼当事人和我们这些普通百姓断定他。”

对照我国司法机关多年来丑闻频传、争议性判决频闻，正义是否被看到伸张还是一个疑问，但肯定的是，司法机关已经留给诉讼当事人及普通百姓留下偏见和不公平的印象。肩负伸张正义重任的司法机关，无法取信于人，这个国家的法治基础还能不溃败吗？（2007年9月21日）

重现全国大罢市膺人权电影奖《独立前十年》槟城上映讲评

荣获2007年电影节“最杰出人权电影”的《独立前10年》将再次来到槟城展开一连两天的播映会，其导演年轻电影工作法米惹札(Fahmi Reza)将和数名著名讲评人分享我国争取独立历史的另一面。

这项放映会是由大马人民之声槟城分部，槟州大专毕业生青年协会(青协) ，韩江电视新闻中心及槟州凤凰友好联谊会联办的播映会，将于本月6日(星期六)及10月7日(星期日) 在韩江学院讲堂举行，时间是晚上8时30分至10时30分。《独立前10年》导演法米惹札两天都会现身和出席者贴身交流。

首日(210月6日)的播映会将以华语为媒介语，讲评人计有著名作家兼政治评论员谢诗坚博士及社会运动活跃份子朱进佳。次日则以国语和英语进行，大马社会主义党总秘书S阿鲁泽文(Arutchelvan)受邀为讲评人。

走访民众学者重现被遗弃历史

在1947年10月6日，各民族大联盟发表了一篇《全国大罢市宣言》，呼吁所有把马来亚当作家园的人士，在1947年10月20日参加全马大罢市一天，表示抗议联合邦宪制建议。《独立前十年》短片所记述的就是发生在1947年10月20日的罢市事件和全马联合行动理事会-人民力量中心AMCJA-PUTERA提出《人民宪法建议书》，反抗英殖民的人民斗争历史。

《独立前10年》一片的导演法米惹札（右图）走访见证这重要历史时刻的民众和历史学者，重现被教科书所遗弃的人民起义运动。

主办单位发表文告指出，电影记述的是单一的历史事件，但体现的是超越单一历史事件，与许多其他草根人民抗争事件共同拥护的独立精神。这个独立精神不是政治精英的特权，而是草根人民的集体回忆。

加上，喧闹的独立50年国庆庆典落幕后，巫统垄断独立历史诠释权的局面依旧。排山倒海的宣传攻势仍企图建构政治精英争取独立的正义形象，而所谓“不流血”的独立运动却成为巩固现存政治集团权力的政治筹码。

反殖民政府流血抗争被边缘化
在历史教科书，人民的反殖民政府的流血抗争被边缘化。在历史教科书，人民反剥削的草根抗争被边缘化。但这段历史事实的存在却是不争的事实。

这段历史活在左派运动的历史文集里，阅览过这些书籍的人却不多。这段历史活在年长一辈的记忆中，回味往事的人也不多。

在草根人民独立精神被孤立的今天，这个集体回忆是必须纵向和横向被转播的。因此，放映会希望通过短片播放，让观众了解罢市的历史经过，并提供一个交流的平台，让点评人和参与者参与讨论。

为广泛吸引不同源流的参与者，两场放映会将个别运用华语和马来语为媒介语。

Call for Applications for AWAM’s Program for Young Women Writers

About the All Women’s Action Society (AWAM)
AWAM is one of the leading women’s non-governmental organizations in Malaysia. Established in 1988, it has been at the forefront of national campaigns and initiatives to combat discrimination against women and to achieve greater legal protection of women and their rights. AWAM was, for example, one of the key organizations involved in campaigns which led to achievements such as the passing of the amendments to Malaysia’s rape related laws in 1989, the enactment of the Domestic Violence Act in 1994 and the introduction of the Code of Practice on the Prevention and Eradication of Sexual Harassment in the Workplace (1999).

In addition to its work on legal reform, AWAM does public education and trainings to raise awareness of women’s and gender issues; and provides counseling, legal advice and other support services for women in crisis.

The Writers for Women’s Rights Program
The WWRP offers promising young women writers a unique opportunity to develop:

their understanding of gender and social justice issues;
their writing and analytical skills and iii) their understanding of media issues and their media relations skills and abilities. This program is open to women between the ages of 18 to 32.

WWRP participants will attend a live-in workshop to be held on 22–25 November 2007, where they will receive training on these areas.

Experienced AWAM writers and trainers will be available to guide them and help them get their work published in the media.

The registration fee to attend the workshop is as follows:

Students or unemployed RM 50
Others RM 100

This fee may be waived or reduced in the case of promising applicants who are facing financial hardship. Such applicants are required to submit an appeal letter explaining their circumstances along with their application materials.

Call for Applications
Those applying for the program should write to or email AWAM providing a brief biodata or résumé of themselves, and a short statement (500 to 800 words) explaining why they are interested in participating in the program and what they hope to gain from it. The deadline for applications is 2 November 2007. Please write ‘WWRP’ as your subject heading and send applications to:

Why did former lord president Hamid Omar refuse to withdraw from chairing a tribunal that led to the removal of his boss, Salleh Abas, during the 1988 judicial crisis?

The answer was revealed by Param Cumaraswamy - the immediate past president of the Bar Council during the 1988 crisis - at a forum in Kuala Lumpur on Saturday.

In 1988, Salleh, the former lord president, was found guilty of judicial misconduct by a special tribunal chaired by Hamid. At that time, Hamid was acting lord president and next in line to succeed Salleh.

Strong objections, especially from the Bar Council, were raised then over Hamid’s role in the tribunal.

At Saturday’s forum, attended by some 250 people, Param disclosed what had transpired at a meeting between a Bar Council delegation led by him and Hamid.

“We went to see Hamid to advise him not to accept the position for the obvious reason that he was next in line. I advised Hamid ‘please don’t (accept), you will cause a very ugly embarrassment to the judiciary,” he said.

“His (Hamid’s) response was ‘Param, if I don’t accept, I will be sacked. If I am sacked, will you or your Bar Council compensate my losses of remuneration?’” he added.

He further quoted Hamid as telling him, “Param, if you want, you can go and advise the King.”

Param, who is also the former UN special rapporteur on the independence of judges and lawyers, said he retorted by telling Hamid that the latter was in a better position to advise the King.

According to him, this conversation with Hamid was never made public or documented until now.

Judges axed

He also explained that the Bar Council president at the time, Raja Aziz Addruse, could not be part of the delegation in the meeting with Hamid since the latter was representing Salleh.

Param was one of the four speakers at the forum titled ‘From Nurin to chief justice: A collapse of law and order?’. It was organised by the Institute for Policy Research.

The sacking of Salleh (photo) in 1988 has been described as the darkest moment in Malaysia’s judicial history.

Former prime minister Dr Mahathir Mohamad had then set up the special tribunal which tried Salleh on charges of misconduct and for questioning the constitutional amendments that seriously eroded the powers of the judiciary.

Two of five supreme court judges - George Seah and Wan Sulaiman Pawan Teh - who had ruled that the tribunal was convened unconstitutionally were also sacked.

The supreme court, which has been renamed as the Federal Court, was then the highest court in the country.

After an 18-year silence, Salleh broke his silence in August last year and came out strongly to support the Bar Council’s call for a review of the 1988 judicial crisis.

However, the government has rejected this.

1988年司法危机有新内情！前律师公会主席巴兰（Param Cumaraswamy）揭露，前最高法院院长哈密奥玛（Hamid Omar）是为了保住权位，才拒绝退出裁决其上司沙列阿巴斯（Salleh Abas ）“司法行为不当”的仲裁委员会。

当时出任代最高法院院长的哈密奥玛所领导的仲裁庭，裁决前最高法院院长（今称联邦法院首席大法官）沙列阿巴斯“司法行为不当”的罪名成立，最后导致后者遭中止职权。

哈密奥玛的做法受到司法界强烈的批评，因为哈密奥玛是沙列阿巴斯的下属，也是继承沙列阿巴斯职位的下一位人士，拥有明显的利益冲突。

“谁来赔偿我失去的酬劳？”

在1988年司法危机发生时刚卸下律师公会主席职的巴兰，上周六在吉隆坡一场讲座上，首次揭露当时他率领代表团与哈密奥玛会晤的情况。

“我们去会见哈密奥玛，劝告他不要接受委任（领导仲裁委员会），原因很明显，他是继承（沙列阿巴斯）的下一人......我劝告哈密奥玛‘请不要（接受），你将让司法界非常难堪’。”

“他的反应是，‘巴兰，你言重了，如果我不接受，我将会被开除；如果我被开除，你或你的律师公会会赔偿我失去的酬劳吗？’”

巴兰透露，当时他并未放弃，进一步建议哈密奥玛向最高元首进言，结果对方却回敬他，“巴兰，如果你要这么做，你自己可以去劝告最高元首”。

曾出任联合国司法独立特派专员的巴兰表示，上述的谈话内容不曾对外公开或记录过。

他也解释说，当时的律师公会主席拉惹阿兹（Raja Aziz Addruse）无法率领与哈密奥玛会晤的代表团，因为拉惹阿兹正是沙列阿巴斯的代表律师。

这场题为“从努琳到首席大法官，法律与秩序的崩溃？”的讲座，由政策研究机构（Institut Kajian Dasar）主办，吸引约250名出席者。另外3名主讲人分别是人民公正党实权领袖安华、国际透明大马分会前主席东姑阿都阿兹（Tunku Abdul Aziz）和大马律师公会秘书林志伟。

政府指缺新证据重审司法危机

1988年沙列阿巴斯（Salleh Abas）与五名最高法院法官被中止职权的事件，被誉为马来西亚司法历史上最黑暗的时刻。

当时沙列阿巴斯代表众多法官去函最高元首，对首相马哈迪抨击司法界的言论表达不满。之后马哈迪指控沙列阿巴斯“司法行为不当”，并成立了一个以哈密奥玛为首的仲裁委员会来审理沙列阿巴斯的案件。最后沙列阿巴斯遭革职。

较后5名最高法院法官的其中两人--佘锦成与万苏里曼（Wan Sulaiman Pawanteh），因为判处上述的仲裁委员会违宪，结果受到另一个仲裁委员会的审讯，同样指他们“司法行为不当”，最后与沙列阿巴斯一起被革职。

最高法院（supreme court）是当时最高的司法机构，目前已改称联邦法院（federal court）。

沙列阿巴斯在去年8月打破18年来的沉默，大力支持律师公会呼吁政府重新检讨1988年的司法危机。

不过，政府最终却以缺乏“新证据”为由，拒绝律师公会的建议。

士可忍，孰不可忍？

国安部指示迫拆劳勿马共公墓家属将上法院挑战县议会通告

一群前马共牺牲家属，因为近期接获劳勿县议会通知书，要求拆除设立在劳勿荣华富贵山庄内风景墓园的马共牺牲人员坟墓，准备入禀法院申请庭令，阻止县议会在14天期限过后，强行摧毁上述公墓。

这些家属已经成立一个《劳务风景园反对毁墓家属委员会》，并今早在隆雪华堂举行记者会，对外说明详情，冀望社会人士给予公评。

这个位于劳勿荣华富贵山庄内风景墓园的马共公墓占用两个墓地，高达4尺，墓碑上只刻上169个阵亡马共成员的名字和他们的阵亡地点。

准备会晤胡亚桥及人权委会

反对毁墓委员会指出，由于事态的紧急和严重，风景墓园园主除了在昨日致函劳务县议会主席，要求展延摧毁公墓期限以寻求一个各方面所能接受的解决方案之外，也已经授权谢春荣律师立即着手申请庭令，阻止市议会在14天限期过后，强行摧毁上述公墓。

反对毁墓委员会除了支持风景园园主的上述行动外，也将尽速安排会见国安部副部长胡亚桥以及向人权委员会投诉，并希望在有关方面的插手下，劳勿县议会能够把有关通告收回成命。

该委员会也呼吁各党团和非政府阻止，密切关注事态的发展，并通过各种实际行动，支援他们维护墓园不被破坏的基本人权和社会伦理与文明。

当初建墓园获得政治部首肯

反对毁墓委员会主席蔡营透露，风景墓园内的前马共牺牲人员，大多数在1973－1988年间为了理想牺牲宝贵性命，在当时的特殊环境下，他们的后事并未得到应有的妥善处理。

该墓园在2002年9月1日建竣，是因为这些“死无葬身之地”的家属深深感到他们亲人的英魂应有个归属，乃于当地建立总坟，以供后人悼念追思。

他指出，该墓园在建立时知会当局，已经取得首肯，整个购地建墓的过程，都是在彭亨州政治部的密切监督下进行。在建竣后，家属们终于得偿心愿，每年清明节都可以到公墓举行祭祀。这5年来，每年的祭祀活动不曾中断，也不曾发生过任何不愉快的事情。而且彭亨州政治部人员也一直在现场全程拍摄祭祀过程，以及出席监听他们的开会或活动。

反对毁墓委员会的文告强调，由于马共已经和马来西亚政府签定合艾和平协定，双方已经化敌为友。因此前马共成员或他们的家属，在处理历史遗留下来的问题时，不应受到任何形式的歧视或迫害，应和其他公民一样，享有我国宪法所赋予的一切权利和国际承认的基本人权。而这些历史遗留下来的问题，就是马共殉难者的后事问题。

岂料，在9月17日劳勿县议会主席竟然向墓园圆主发出通知书，援引1974年道路、沟渠和建筑物法律第72（1）（b）条文，限期在14天内圆柱必须自行摧毁上述公墓，否认限期过后，等于自动要求县议会执行有关的毁墓工作。

在有关通告发出之前，蔡营指出家属代表曾经两度被通知前往劳务劳务县议会和国安部、政治部及县议会官员，讨论有关事项。

家属代表指出，有迹象显示，劳务县议会是奉国安部的指示行事，尽管他们对国安部这项无理的意图，已经作了必要的揭露和反对。而反对毁墓委员会顾问李万千也证实，地方上的政治部官员表示他们只是接受中央的指示而已。

家属也提出5点看法重申说：

1）有关公墓是建筑在私人墓园里，仅供家属祭祀和追思，不时供公众人士凭吊的纪念碑。

2）有关公墓和风景墓园里的其他坟墓一样，是在购地后按照墓园的一般条例和要求兴建，如果其他坟墓不违法，它也同样不应该是违法的。

3）有关公墓得到彭亨州政治部的认可在先，现在如果国安部又指示劳勿市议会加以摧毁，是否有“朝令夕改”之嫌，教人何去何从？

4）摧毁坟墓对华人或其他民族来说，都是绝对禁忌的。不论对死者或活着的家属来说，都是一项极端冒犯的作法。

5）这种不文明的意图，对解决历史遗留下来的问题不但没有任何好处，也是对基本人权的严重侵犯，家属们必将抗争到底。

出席记者会的代表律师谢春荣（左图）也质疑有关当局是在钻法律的漏洞，来企图摧毁马共的公墓，因为墓碑根本不符合县议会所援引的道路、沟渠和建筑物法律条文里头的建筑物类别。他说，若此例一开，以后我国所有的墓碑将会被迫要向有关当局申请图测。

谢春荣及李万千皆炮轰毁墓的举动不文明，不符合人情。谢春荣更质问国家若无最基本的宽容，还谈信奉什么自由、民主原则？

而涉及去年森美兰州汝来抗日纪念碑发生差点被拆除的风波的爱国工委会主席符昌和也指出，既然犯人以及两国交战人士阵亡都被允许领回尸体，不应追究历史的谁是谁非，建立墓碑纪念阵亡人士没有不对的地方。

另一名家属廖保忠（右图）则表示其父母亲，因为有了墓碑祭祀其阵亡的妹妹而感到安慰，如今他们若泉下有知墓碑被毁，将会感到不安宁，而他也会因为再也无法拜祭其妹妹而感到很难过。

FFF07 will also premiere the screenings of the winning film proposals with the theme "50th Merdeka – The Untold Human Rights Stories". The three outstanding scripts chosen were:

"Forgotten", a documentary by Penangite Ong Boon Keong, about the right to land by more than 2000 jetty settlers in Weld Quay, Georgetown who have been labeled as squatters, "She's My Son" by Indrani Kopal, a documentary about the life of a transgendered Malaysian told through the eyes of her mother and "Sepuluh Tahun Sebelum Merdeka" by Fahmi Reza, a documentary about the hidden history behind the democratic struggle and political independence of Malaya .

大馬迪斯尼狂想曲（第一回合） ■龍耀福

新加坡開賭場，我們都了解，所有的賭鬼、賭神、賭聖、賭剷、賭霸、賭爛......到時都會涌向新加坡。

我國政府真的有先見之明，所以“邦邦聲”宣佈有意讓迪斯尼在大馬落腳。

新加坡建立了賭場後，不管你likey或否，遊客都會大量涌向新城，大馬的旅遊市場會嚴重被“分豬肉”。

有人說，新加坡遊客遊玩新加坡後，會順路來馬，反而增加我國遊客。

大佬，這是什麼邏輯﹖獅城賭場還未開始，你就開始要押寶賭新加坡遊客可能遊玩新加坡花完錢後，再順便來馬走一下，或者、可能、也許、maybe、mungkin購買一兩樣東西，幫助刺激大馬經濟﹖

這種“順便中的邏輯”賭博想法，最後結果是“圍骰”統殺﹗做生意的人都知道的基本理論，自己不受制于人，才是勝利之本。發表上述“偉論”的人，小弟只能遺憾的說，你不是做生意的kaki。

大馬的自知之明

談回我們的政府，較早前放風聲要興建迪斯尼，的確具有與新加坡抗衡的味道，是好事，是有競爭力，惟獨欠缺自知之明。

不過，不用怕，小弟知道所有內幕，可以告訴政府的自知之明。

以下是迪斯尼派來的談判代表與大馬各“有關當局”談判的經過。(對話由小弟好兄弟007占屎謗提供，如有雷同，純屬人家抄襲)。

政客A﹕還有泰山這個野人，不能只穿底褲這麼不文明，最好能帶個宋谷，讓國人feel到親切感。還有雖然他是萬獸之王，但是最好不要有....那只動物出現啦，很敏感的，我怕群眾會示威，流血衝突，影響國家團結及安全。

The Malaysian Communications and Multimedia Commission (MCMC) has been ordered to withdraw its directive barring private owned television stations from airing speeches by opposition leaders.

“I wrote a letter to MCMC on Tuesday instructing the commission to withdraw its directive with immediate effect,” Energy, Water and Communications Minister Dr Lim Keng Yaik told reporters in the Parliament lobby today.

Lim said he did not know of the directive as he was overseas and found out about it after reading it in the newspapers.

“I investigated the matter once I got to know about it,” he said, adding that MCMC should not have issued such a directive.

He also said MCMC could have issued the directive based on its interpretation that airing recorded speeches by opposition parliamentarians was prohibited as parliament proceedings are not telecast live.

On June 29, malaysiakini published a letter issued by MCMC directing all private owned TV stations to stop airing opposition speeches.

The one-page letter said that the directive should be implemented immediately.

Motion rejected
Meanwhile, an urgent motion to debate the directive was rejected in Parliament today.

The motion, moved by Tan Kok Wai (DAP-Cheras), said that MCMC’s directive suppressed freedom of information.

“The directive deprives the public from a free flow of information and needs to be looked into immediately,” he said

However, Speaker Ramli Ngah Talib rejected the motion on the ground that it does not need immediate action under Standing Order 18(2).

“I was told that the relevant ministry had issued an order to cancel the directive,” said the Speaker.

Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM) telah diarahkan supaya menarik balik arahannya kepada stesen televisyen swasta supaya jangan menyiarkan ucapan pemimpin pembangkang.

“Saya telah menulis kepada SKMM hari ini mengarahkan suruhanjaya itu menarik balik serta merta arahan tersebut," kata Menteri Tenaga, Air dan Komunikasi, Datuk Seri Dr Lim Keng Yaik kepada pemberita di lobi Parlimen hari ini.

Lim berkata, beliau tidak tahu menahu mengenai arahan tersebut kerana berada di luar negara dan mengetahui mengenainya selepas membacanya dalam akhbar.

“Saya telah menyiasat perkara itu sebaik sahaja saya dapat tahu mengenainya," tambahnya, sambil menambah SKMM tidak sepatutnya mengeluarkan arahan seumpama itu.

Beliau juga berkata, SKMM mungkin mengeluarkan arahan tersebut kerana menganggap penyiaran rakaman ucapan ahli Parlimen pembangkang adalah dilarang kerana persidangan Parlimen bukan siaran langsung.

Pada 29 Jun lalu, malaysiakini menyiarkan surat SKMM itu yang mengarahkan pemilik stesen TV swasta supaya berhenti serta merta menyiarkan ucapan pemimpin pembangkang.

Usul ditolak
Sementara itu, satu usul tergempar untuk membincangkan arahan tersebut ditolak oleh DewanRakyat hari ini.

Usul tersebut yang dikemukakan oleh Tan Kok Wai (DAP-Cheras) menyebut bahawa arahan SKMM itu menyekat kebebasan maklumat.

Menurutnya, arahan tersebut telah menafikan hak rakyat mendapatkan saluran maklumat dan perlu diberi perhatian segera.

Bagaimanapun, Speaker Dewan Rakyat, Tan Sri Ramli Ngah Talib menolak usul tersebut atas alasan ia bukan memerlukan tindakan segera di bawah Peraturan Tetapi 18(2).

林敬益表示，他根本不知道该委员会曾经发出此公函，直到反对党通过报章揭露及准备今天在国会提出紧急动议。

《当今大马》在6月29日独家报道，证实马来西亚通讯及多媒体委员会曾发函指示私营电视台与电台，停止播出反对党领袖的演讲。

这份志期2007年6月7日的公函，印有马来西亚通讯及多媒体委员会主席哈林（Dr Halim Shafie）的信笺，并由能源、水务及通讯部秘书长哈林（Dr Halim Man）签署。

马来西亚通讯及多媒体委员会是能源、水务及通讯部底下的一个委员会，负责管制所有私营电视台与电台，以及网际网络的内容，并发出执照予私营电视台与电台。国营电视台与电台则属于新闻部的管辖。

他表示，在行动党蕉赖国会议员陈国伟向他展示该委员会的公函后，他便亲自致函该委员会要求撤回有关指令，该公函指示即日起无效。

陈国伟提紧急动议修法遭驳回
根据《中国报》报道，较早前陈国伟（左图）也在国会下议院问答环节结束后，援引议会常规第18（1）条文，提出通讯与多媒体委员会阻止电台和电视台播放反对党演讲的紧急动议。

他提呈动议时说，我国是民主国家，此指示侵犯了基本人权，剥夺人民了解事实的自由。

陈国伟也建议修改相关的法令，包括出版与印刷法令等，确保人民有求知的权力。他强调，媒体必须拥有足够的自由与发展空间，不能受到政府约束，失去了主要功能。

不过，下议院议长南利经过考虑后，以通讯部已发出撤销此公函的指示，而援引议会常规第18（2）条文，驳回上述动议。

How can I read them all? In fact, I don't read all. Haha! I subscribed their RSS feeds, put it into my favorite RSS reader NetVibes and read the article only if the title attracts me. Sounds easy huh?

Opposition muzzled - here's black and white proof

It’s an open secret that the government issues directives to state-owned television and radio stations to black out the opposition. But it now appears that private stations also receive similar directives.

Malaysiakini has obtained a copy of the letter from the Malaysian Communications and Multimedia Commission (MCMC) ordering all private TV and radio stations to stop airing speeches by opposition leaders. [See original letter]

“The government has noted that several private TV and radio stations have been airing speeches by opposition party leaders,” wrote MCMC chairman Dr Halim Shafie in the June 7 letter.

“Your station is requested not to broadcast such speeches in future.”

The one-page letter added that the directive should be implemented immediately.

Halim could not be reached for comment.

MCMC, a government agency under the Energy, Water and Communications Ministry, is empowered to regulate matters relating to communications and multimedia activities, including private TV and radio stations as well as Internet websites.

The licencing of private TV and radio stations comes under its purview.

The letter was carbon-copied to Energy, Water and Communications Ministry’s secretary general Dr Halim Man.

No such directive

Yesterday, private station ntv7 denied opposition party claims that it had received a directive ordering it to censor opposition comments in news broadcasts.

Opposition member of parliament Tan Kok Wai told a press conference on Wednesday that he had received information from a reliable source of a directive to the media to stop airing comments from opposition parties.

The DAP parliamentarian said the directive tantamount to political discrimination against opposition parties.

Memang menjadi rahsia umum bahawa stesen radio dan televisyen milik kerajaan diarahkan supaya jangan menyiarkan tentang pembangkang. Tetapi kini stesen radio dan televisyen swasta juga tidak terlepas daripada arahan yang sama.

Malaysiakini memperolehi salinan surat yang dikeluarkan oleh Suruhanjaya Komunikasi dan Multimedia Malaysia (SKMM) yang mengarahkan semua stesen radio dan televisyen swasta supaya berhenti menyiarkan ucapan pemimpim pembangkang. [Lihat surat asal]

“Adalah dimaklumkan bahawa pihak kerajaan mendapati bahawa beberapa stesen-stesen TV dan radio swasta telah menyiarkan ucapan dari pemimpin parti pembangkang,” kata Pengerusi SKMM, Datuk Dr Halim Shafie dalam surat bertarikh 7 Jun lalu.

“Sehubungan dengan itu, pihak tuan adalah diminta untuk tidak lagi menyiarkan ucapan sedemikian di masa akan datang,” tambahnya.

Menurut surat itu lagi, mereka diminta melaksanakan serta merta arahan tersebut.

Halim tidak dapat dihubungi untuk mengulas mengenai arahan tersebut.

SKMM adalah agensi kerajaan di bawah Kementerian Tenaga, Air dan Komunikasi, mempunyai kuasa untuk mengawal perkara berkaitan dengan aktiviti komunikasi dan multimedia, termasuk stesen radio dan televisyen swasta serta lamanweb internet.

Bidangkuasanya merangkumi urusan pelesenan stesen radio dan televisyen swasta.

Salinan surat tersebut turut dihantar kepada Ketua Setiausaha Kementerian Tenaga, Air dan Komunikasi, Datuk Dr Halim Man.

Semalam, stesen televisyen swasta, ntv7 menafikan dakwaan parti pembangkang bahawa ia telah menerima arahan supaya tidak menyiarkan komen pihak pembangkang.

Rabu lalu, Ahli Parlimen DAP, Tan Kok Wai memberitahu satu sidang akhbar bahawa beliau telah mendapat maklumat dari sumber yang layak dipercayai mengenai arahan tersebut.

Beliau menyifatkan arahan itu sebagai satu bentuk diskriminasi terhadap parti-parti pembangkang.

反对党社会民生新闻照样遭封杀

行动党雪州副主席陈彼得也揭露，《八度空间》和《ntv7》两家电视台日前临时拒绝出席由他所安排的非法养鸡新闻活动。

而林冠英也申诉，早前马六甲发生一宗罕见的谋杀案，死者家属前来向他求助，但是这则新闻也同样遭遇封杀的命运。

他说，新闻封锁行动除了针对政治新闻之外，就连反对党所处理的社会民生新闻也同样面对封杀的命运。

林冠英指出，一些电视台编辑还透露，不委派记者出席行动党活动的原因是因为上头已经发出封杀的指示，所以“不想浪费资源和时间”。

行动党蕉赖国会议员陈国伟也曾向《当今大马》证实，他在为17名前来我国担任脚底按摩师的中国籍女子申诉，指遭雇主报假案和不合理对付一案，《八度空间》与ntv7只播出中国籍女子律师和新闻主播的报道，而他针对这个课题所发表的谈话，一概无法出街。

据悉，两家电视台因报道此案，已接获上头的口头警告，要求它们贯彻内阁封杀反对党新闻的指令。

怎么搞的？滥权阻止媒体报道有关反对党的言论与活动，然后再来质问反对党有何贡献吗？是要制造太平盛世的假象吗？是怕有碍国誉吗？
